Welcome to TABKO! The terms “we”, “us” and “our” refer to TABKO. TORUS3D, a design services sole proprietorship, owned by Andrej Šimleša, Tenja, Ulica Jure Kaštelana 56, operates this store and website, including all related information, content, features, tools, products and services to provide you, the customer, with a customized shopping experience (“Services”). TABKO is powered by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they contain important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy at https://www.tabko.shop/policies/privacy-policy. If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access our Services.
ARTICLE 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are of legal age in your country or province of residence, or that you have given us your consent to allow any of your minor dependents to use the Services on devices that you own, purchase, or manage.
To use the Services, including accessing or browsing our online stores or purchasing any products or services we offer, we may require you to provide certain information, such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all necessary rights to provide such information.
You are solely responsible for maintaining the security of your account credentials and for all activities that occur under your account. You may not transfer, sell, assign, or license your account to any other person.
ARTICLE 2 – OUR PRODUCTS
We have made every effort to display our products and services accurately in our online stores. However, please note that colors or product appearance may vary depending on your device type and its settings and configuration.
We do not guarantee that the appearance or quality of any product or service purchased will meet your expectations or be identical to what is displayed in our online stores.
All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities of any product offered to any person, geographic region, or jurisdiction on a case-by-case basis.
All products are handmade to order and shipped within 5 business days after payment confirmation.
ARTICLE 3 – ORDERS
By placing an order, you make an offer to purchase. TORUS3D/TABKO reserves the right to accept or reject your order for any reason at its sole discretion. Your order is not accepted until TORUS3D/TABKO confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting it, as TORUS3D/TABKO may not be able to accommodate cancellation requests once an order has been accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at checkout.
Your purchases are subject to returns or exchanges solely in accordance with our Refund Policy at https://www.tabko.shop/policies/refund-policy.
You represent and warrant that your purchases are for personal or household use only and not for commercial resale or export.
All products are handmade to order and shipped within 5 business days after payment confirmation.
ARTICLE 4 – PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be shown in your order confirmation email. Unless expressly stated otherwise, published prices do not include taxes, shipping, handling, customs duties, or import charges.
Prices displayed in our online stores may differ from prices offered in physical stores or online or other stores operated by third parties. From time to time, we may offer promotions governed by terms separate from these Terms. In the event of a conflict, the promotion terms will prevail.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update your account and other information so we can complete transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, accurate, and complete; (ii) you are authorized to use the credit card; (iii) charges incurred will be honored by your card issuer; and (iv) you will pay all charges incurred at the posted prices, including shipping, handling, and applicable taxes.
TORUS3D, a design services sole proprietorship owned by Andrej Šimleša, is not registered for VAT, and VAT is not charged pursuant to Article 90, paragraph 2 of the Croatian VAT Act.
ARTICLE 5 – SHIPPING AND DELIVERY
We are not responsible for shipping or delivery delays. All delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events beyond our control. Once products are handed over to the carrier, ownership and risk of loss transfer to you.
ARTICLE 6 – INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, trade names, text, displays, images, graphics, product reviews, videos, and audio, and their design, selection, and arrangement, are owned by TORUS3D, its affiliates, or licensors and are protected by U.S. and international intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent.
Nothing in these Terms grants any license or right to you under any patent, trademark, copyright, or other intellectual property of TORUS3D, Shopify, or any third party. Unauthorized use may violate applicable laws. All rights not expressly granted are reserved by TORUS3D.
Names, logos, product and service names, designs, and slogans of TORUS3D/TABKO are trademarks of TORUS3D/TABKO or its licensors. Shopify’s name and logo are trademarks of Shopify. All other trademarks are the property of their respective owners.
ARTICLE 7 – OPTIONAL TOOLS
We may provide access to third-party tools that we do not monitor or control. You acknowledge that such tools are provided “as is” and “as available” without warranties or support, and we assume no liability arising from their use.
Use of optional third-party tools is entirely at your own risk and discretion. Any new features or tools added in the future will also be subject to these Terms.
ARTICLE 8 – THIRD-PARTY LINKS
The Services may include links to third-party websites. We are not responsible for examining or evaluating their content or accuracy. Accessing third-party sites is at your own risk.
We are not liable for any damages related to your use of third-party websites or products. Complaints or questions regarding third-party products should be directed to the third party.
ARTICLE 9 – RELATIONSHIP WITH SHOPIFY
The store is powered by Shopify, but all sales are conducted directly with TORUS3D/TABKO. Shopify is not responsible for any aspect of transactions between you and TORUS3D/TABKO. You expressly release Shopify from any claims arising from your purchases.
ARTICLE 10 – PRIVACY POLICY
Personal data collected through the Services is governed by our Privacy Policy and, in some cases, Shopify’s Privacy Policy. By using the Services, you confirm that you have read these policies.
Because Shopify hosts the Services, your information may be processed and transferred to other countries to provide the Services.
ARTICLE 11 – FEEDBACK
If you submit feedback, ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use it for any purpose. You represent that you have the right to submit such Feedback and that it complies with these Terms.
We are not obligated to keep Feedback confidential, compensate you, or respond to it.
ARTICLE 12 – ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on the Services that contains errors or inaccuracies. We reserve the right to correct errors and cancel orders if information is inaccurate, at any time without prior notice.
ARTICLE 13 – PROHIBITED USES
You may use the Services only for lawful purposes. Prohibited uses include illegal activity, infringement of intellectual property, harassment, transmitting false information, spamming, impersonation, and interfering with security features.
We reserve the right to suspend or terminate your account for violations.

We may terminate this agreement or your access to the Services at any time without notice. You remain responsible for all amounts due up to the termination date.
Certain provisions will survive termination, including intellectual property, disclaimers, and limitation of liability.

You agree to indemnify and hold harmless TORUS3D and Shopify from claims arising from your breach of these Terms or violation of any law.
ARTICLE 18 – SEVERABILITY

ARTICLE 19 – WAIVER; ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and us and supersede prior agreements.

You may not assign these Terms without our consent. We may assign our rights without notice.
ARTICLE 21 – GOVERNING LAW
These Terms are governed by the laws of the jurisdiction where TORUS3D is registered.
ARTICLE 22 – HEADINGS
Headings are for convenience only and do not affect interpretation.
ARTICLE 23 – CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Services constitutes acceptance of changes.
